Notary commission verification confirms that a notary public is currently commissioned and authorized to perform notarial acts in a given state. A notarization performed by a commission-expired, suspended, or non-existent notary is legally defective — which can invalidate deeds, loan documents, affidavits, and powers of attorney. Real estate professionals, title agents, lenders, and legal professionals should verify notary credentials before accepting any notarized document. Frequently Asked Questions

Common questions

What happens if a notarization is defective?
A defective notarization — performed by an expired or unauthorized notary — can render the document legally invalid. For real estate transactions, this can cloud title. For loan documents, it may give a borrower grounds to challenge enforceability. The severity depends on the document type and state law.
How do I verify a notary's commission?
Search the official notary database for the state where the notarization was performed. Confirm that the commission was active on the date the document was notarized — not just currently active.
What is remote online notarization (RON)?
RON allows a notary to perform notarial acts via two-way audio-visual technology. The notary's state of commission governs the act. Verify that the notary is specifically authorized for RON in their commission record, and that the state where the notarization was performed has enacted RON legislation.
Can a notary notarize their own documents?
No. A notary public cannot notarize a document in which they have a financial interest or are named as a party. This is disqualifying in all states.
